normativa People with epilepsy cannot be discriminated against because of their illness. The Spanish Constitution garantees this basic right to all its citizens.

Epilepsy is an unpredictable illness and the clinical symptomatology can be associated with the temporary inability to perform activities. Because of this, those who have epilepsy are not able to perform certain professional activities because of the risk to the person and/or the citizen.

This regulation will vary from country to country. If you need more information about the following restrictions, you should seek the information from the country in which you reside.

 
Use of Weapons

utilizacion de armasIn Spain, all people without exception who have epilepsy are prohibited from using weapons.

Sports Activities

The majority of people with epilepsy can practice sports as long as it is moderate and under supervision. Those sports considered to be high risk, solitary or very dangerous should the patient have a seizure whilst performing are:

  • Motor sports: car and motorbike.
  • Underwater sports: professional diving, underwater fishing, etc. .
  • Hunting and olympic shooting.
  • Aeronautics.
  • Mountaineering.
Blood donation

donacion de sangreThe law states that those people who have epilepsy are not able to donate their blood even though they may be in an anti-epileptic treatment.

Professions which are restricted to those who have epilepsy

The restricted professions are:

  • Professional military services: one is disqualified from the military services when they suffer from seizures. 
    Part 7/1987, 29th Jan 1987, BOD Ministry of Defence published 13th Feb.
  • Police force: a diagnosis of epilepsy constitutes a medical exclusion from the all police forces.
  • Civil guard (responsability outside towns and cities): the textual medical exclusion from the civil guard is "seizures or similar" like epilepsy and others. 
  • Prison guards: Epilepsy is a definitive cause of exclusion both in exams and active service. 
  • Private security: those with epilepsy cannot do this work because they are not able to carry weapons.
  • Aeroplane and helicopter pilots: a diagnosis of epilepsy means that one is unable to get the medical certificate required to pilot an aeroplane or helicopter.
  • Air controller: It is required that the worker does not have a nervous system illness or epilepsy.
  • Maritime professions: legislation prevents access to maritime professions to those who have chronic illnesses and organic nervous system functions.
    Ministerial order 1st March 1973. BOE No 56, 6th March 1973.
  • Professional divers: any nerve disease like epilepsy will prevent the person from being a professional diver.
  • Railway worker: current legislation stipulates that no person with epilepsy can work in professional groups with the greatest responsibility as per the scales defined by Renfe. Workers have a series of check ups periodically with reference to responsibility and the work place. With reference to legislation: Renfe. Presidency. Circular 13/1992 medical check ups and minimum conditions in work capability. 
Driving vehicles

conduccion de vehiculosSpanish law prohibits a person who has epilepsy during the day and who has had a seizure during the last year from driving.
